Welcome to Fresh Start Women's Foundation's membership Website at www.wehelpwomen.com. This site provides members with a free personal life assessment resulting in a customized program of interactive courses dealing with such topics as finance, career, health, family and empowerment. By using the wehelpwomen.com Website, (the "Service") you agree to be bound by these Terms of Use. These Terms of Use govern our relationship with users and others who interact with wehelpwomen.com. If you object to anything in this Agreement or the Fresh Start Women's Foundation's Privacy Policy, do not use the Website or the Service.

TERMS OF USE

BY ACCEPTING THESE TERMS BY CLICKING A BOX INDICATING YOUR ACCEPTANCE OR BY USING OR ACCESSING WEHELPWOMEN.COM, YOU AGREE TO THESE TERMS OF SERVICE, IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICE.
This Agreement was last updated on March 31, 2011. These Terms are subject to change by Fresh Start Women's Foundation at any time, effective upon posting on the wehelpwomen.com Website, and your use of the Service after such posting will constitute acceptance by you of such changes.

1. DEFINITIONS

  • "Access" or "Accessing" means accessing, downloading, and viewing content (or otherwise obtaining information) on the Site solely for User's own personal non-commercial use.
  • "Affiliate" means any entity which directly or indirectly controls, is controlled by, or is under common control with the subject entity. "Control," for purposes of this definition, means direct or indirect ownership or control of more than 50% of the voting interests of the subject entity.
  • "Agreement" or "Terms" refers to these Terms Use and any subsequent modifications.
  • "Malicious Code" means viruses, worms, time bombs, Trojan horses and other harmful or malicious code, files, scripts, agents or programs.
  • "Fresh Start" means Fresh Start Women's Foundation
  • "Content" means the content and information you post on wehelpwomen.com, including information about You and the actions You take.
  • "Online Courses" means the subscription-based database of instructional videos that is available through the Site and is part of the Site.
  • "Post" means posting (writing or uploading) content on wehelpwomen.com or otherwise make available to us.
  • "Premium Content" means the instructional videos and other media available to the Online Courses, including the Exercise Files.
  • "Services" means the online, Web-based applications and platform provided by Us via http://www.wehelpwomen.com and/or other designated Websites that are used by You as part of our Beta, Free, or Paid services.
  • " Site" means the features and services we make available, including through (a) our website at www.wehelpwomen.com and any other Fresh Start branded or co-branded we sites (including sub-domains, international versions, and mobile versions); (b) our Platform; and (c) other media, devices or networks now existing or later developed.
  • "Subscriber" refers to any person or entity that purchases or uses a membership subscription to the Fresh Start site
  • "Us," "We" or "Our" means Fresh Start Women's Foundation
  • "User" refers to any individual who Accesses the Site.
  • "Website" or "Site" means the features and services we make available, including through (a) our Website at www.wehelpwomen.com and any other Fresh Start branded or co-branded Websites (including sub-domains, international versions, and mobile versions); (b) our Platform; and (c) other media, devices or networks now existing or later developed.
  • "You" or "Your" refers to the User who is accepting this agreement.
  • "Your Data" means all electronic data or information submitted by You to Fresh Start.

2. MODIFICATION OF TERMS

Fresh Start Women's Foundation reserves the right to modify these Terms of Use at any time. Except as otherwise stated herein, any change to these Terms is effective immediately after Fresh Start gives notice to the User. Notice can be given through email or a through posting on the Site or any other means by which a User may obtain notice. User agrees to check the Site periodically for changes to these Terms. Any use of the Site after changes have been made shall be deemed acceptance of those changed terms and/or conditions.

3. LIMITED LICENSE

Fresh Start hereby grants each Subscriber a limited, non-exclusive, non-sublicensable and non-transferable license to Access the content and information available on wehelpwomen.com according to the provisions contained herein, and subject to the payment of the applicable subscription fees and adherence to these Terms.

4. USE OF SERVICES

4.1 Our Responsibilities.

We shall: (i) provide to You basic support for all Fresh Start Service at no additional charge, (ii) use commercially reasonable efforts to make the Purchased Services available 24 hours a day, 7 days a week, except for: (a) planned downtime or (b) any unavailability caused by circumstances beyond Our reasonable control, including, without limitation, acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems (other than those involving Our employees), or Internet service provider failures or delays, and (iii) provide the Purchased Services only in accordance with applicable laws and government regulations.

4.1.1 Privacy

Your privacy is very important to us. We designed our Privacy Policy to make important disclosures to you about how we collect and use the information you post on wehelpwomen.com. We encourage you to read the Privacy Policy, and to use the information it contains to help make informed decisions.

4.1.2 Sharing Your Content and Information

You own all of the content and information You post on wehelpwomen.com. In order for Us to use certain types of content and provide You with Access to wehelpwomen.com, You agree to the following:

For content that is covered by intellectual property rights, like photos and images ("IP content"), You specifically give Us the following permission, subject to Your account settings: You grant Us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that You post on or in connection with wehelpwomen.com ("IP License"). This IP License ends when You delete Your IP content or Your account (except to the extent Your content has been shared with others, and they have not deleted it).

When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, You understand that removed content may persist in backup copies (but will not be available to others).

We always appreciate Your feedback or other suggestions about wehelpwomen.com, and You understand that We may use them without any obligation to compensate You for them (just as You have no obligation to offer them).

4.1.3 Safety

We do our best to keep wehelpwomen.com safe, but we cannot guarantee it. We need Your help in order to do that, which includes the following commitments:

  • You will not send or otherwise post unauthorized commercial communications to users (such as spam).
  • You will not collect users' information, or otherwise Access wehelpwomen.com, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
  • You will not upload viruses or other malicious code.
  • You will not solicit login information or access an account belonging to someone else.
  • You will not bully, intimidate, or harass any user.
  • You will not post content that is hateful, threatening, racist, pornographic, or that contains nudity or graphic or gratuitous violence.
  • You will not use wehelpwomen.com to do anything unlawful, misleading, malicious, or discriminatory, or defamatory.
  • You will not facilitate or encourage any violations of this Safety section 4.1.3.4.1.4 Registration and Account Security

Fresh Start Subscribers provide their real names and information, and We need Your help to keep it that way. Here are some commitments You make to us relating to registering and maintaining the security of your account:

  • You will not provide any false personal information on wehelpwomen.com, or create an account for anyone other than yourself without permission.
  • You will not use wehelpwomen.com if you are under 18.
  • You will not use wehelpwomen.com if you are located in a country embargoed by the U.S., or are on the U.S. Treasury Department's list of Specially Designated Nationals.
  • You will keep your contact information accurate and up-to-date.
  • You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
  • You will not transfer your account to anyone without first getting our written permission.

4.2. Your Responsibilities.

You shall (i) be responsible for Users' compliance with this Agreement, (ii) be solely responsible for the accuracy, quality, integrity and legality of Your Data and of the means by which You acquired your Data, (iii) use commercially-reasonable efforts to prevent unauthorized access to or use of the Services, and notify Us promptly of any such unauthorized access or use, and (iv) use the Services only in accordance with applicable laws and government regulations. You shall not (a) make the Services available to anyone other than Users, (b) sell, resell, rent, or lease the Services, (c) use the Services to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights, (d) use the Services to store or transmit Malicious Code, (e) interfere with or disrupt the integrity or performance of the Services or third-party data contained therein, or (f) attempt to gain unauthorized access to the Services or their related systems or networks.

We respect other people's rights, and expect You to do the same.

  • You will not post content or take any action on wehelpwomen.com that infringes someone else's rights or otherwise violates the law.
  • You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
  • We can remove any content you post on wehelpwomen.com if we believe that it violates our Terms of Use
  • If you repeatedly infringe other people's rights, we will disable Your account when appropriate.
  • You will not use our copyrights or trademarks (including Fresh Start, Fresh Start Women's Foundation, wehelpwomen.com or Fresh Start logos), without our written permission.
  • You will not "frame" or "mirror" any part of the Service or the Website, without Our written permission.
  • You will not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or Site or any software used on or for the Service or cause others to do so.
  • If you collect information from Users, you will: obtain their consent, make it clear You (and not Fresh Start) are the one collecting their information, and post a privacy policy explaining what information You collect and how You will use it.
  • You will not post anyone's identification documents or sensitive financial information on wehelpwomen.com.
  • You also shall not use meta tags or code or other devices containing any reference to Fresh Start, wehelpwomen.com or the Service or the site in order to direct any person to any other Website for any purpose

5. SUBSCRIPTION FEES, RENEWALS, AND REFUND POLICIES

The following describes Fresh Start's policies for subscription fees, subscription renewals, and refunds.

Subscribers Fees

Fresh Start offers two types of subscription plans: monthly and annual.

Monthly Subscription Plan Policies:

  • Access to Premium Content only upon payment of the subscription fees
  • Automatically renews monthly until cancelled by Subscriber
    • Fees automatically charged on renewal date; automatically renews on the same date of each corresponding month or on final date of month if no corresponding date
  • Subscription fees are non-refundable; except that Subscriber may cancel a current subscription by visiting their personal profile page.
  • Discounts, rebates or other special offers only valid for initial term; subscriptions renew at the then-current full subscription rates
  • Fresh Start may increase subscription fees for a subsequent subscription period at any time and for any reason, provided, however, that Fresh Start provides notice at least thirty (30) calendar days prior to the expiration of the subscription
  • Fresh Start may terminate the subscription and these Terms if unable to renew the subscription using the credit card information provided by the User

Annual Subscription Plan Policies:

  • Access to Premium Content only upon payment of the subscription fees
  • Automatically renews yearly until cancelled by Subscriber
    • Fees charged on renewal date; automatically renew on the same date of each corresponding year or on final date of month if no corresponding date
  • Only subscriptions purchased after the effective date of these Terms shall automatically renew as set forth herein
  • Subscription fees are non-refundable; except that Subscriber may cancel a current subscription by visiting their personal profile page.
  • Discounts, rebates or other special offers only valid for initial term; subscriptions renew at the then-current full subscription rates
  • Fresh Start may increase subscription fees for a subsequent subscription period at any time and for any reason, provided, however, that Fresh Start provides notice at least thirty (30) calendar days prior to the expiration of the subscription
  • Fresh Start may terminate the subscription and these Terms if unable to renew the subscription based on inaccurate or outdated credit card information

6. GIFT SUBSCRIPTIONS AND SPONSORSHIPS

In the future, Fresh Start may offer users the opportunity to purchase a gift subscription or sponsorship subscription for a one-month, three-month, six-month or one-year subscription to Premium Content. After a person purchases a gift subscription, Fresh Start will send a Welcome email to the recipient informing them of their receipt of that gift subscription.
Gift and Sponsorship Subscription Terms and Conditions

  • No refunds
  • No exchange or surrender for cash value
  • If an existing Subscriber receives a Premium gift subscription or sponsorship and she already has a subscription to the Premium Content, Fresh Start will apply the gift subscription after the termination of the person's existing subscription
  • A recipient's use of a gift subscription constitutes acceptance of—and agreement to—these Terms of Use

7. ACCESS TO PREMIUM CONTENT; MODIFICATION OF CONTENT.

Fresh Start strives to provide Premium Content to its Subscribers on a continuous basis. To that end, Fresh Start will take all commercially reasonable efforts to provide uninterrupted Access to the Premium Content to its Subscribers. However, from time to time, Subscribers may be unable to Access the Premium Content due to conditions beyond Fresh Start's control. Such conditions include, but are not limited to: force majeure, acts of God, power outages, and the acts of computer hackers and others acting outside the law. Also, from time to time, Access may be unavailable due to software issues, server downtime, increased Internet traffic or downtime, programming errors, regular maintenance of the system, and other related reasons. In response to any unavailability of Premium Content to its Subscribers, Fresh Start will take all commercially reasonable steps to ensure Access is restored within a reasonable period of time. The term "commercially reasonable," as used in these Terms, shall mean reasonable efforts taken in good faith without an unduly or burdensome use or expenditure of time, money, resources, or personnel.

Fresh Start endeavors to provide the highest quality content to its Subscribers. To that end, Fresh Start reserves the right, in its sole discretion, to change, modify, or discontinue any aspect or feature on this Site in whole or in part, including, without limitation, the content, availability, Access and/or the Terms of this Site. Such changes, modifications, additions or deletions will be effective immediately upon notice thereof, which notice may be made by posting such changes on this Site.

Users are solely responsible for ensuring that they have sufficient and compatible hardware, software, telecommunications equipment and Internet service necessary for use of the Site.

8. WARRANTIES, LIMITATION OF LIABILITY AND DISCLAIMERS

USER ACCESSES THIS SITE AT HIS/HER/ITS OWN RISK. THE SITE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESSED, IMPLIED OR STATUTORY, AND ANY AND ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS ARE SPECIFICALLY DISCLAIMED. FRESH START DOES NOT WARRANT ANY PARTICULAR RESULT FROM USE OF THE SOFTWARE OR SITE. FRESH START DOES NOT WARRANT THAT THE INFORMATION ON THE SITE IS ACCURATE, COMPLETE OR COMPLIES WITH ANY PARTICULAR LAW OR REGULATION, OR THAT THE OPERATION OF AND YOUR ACCESS TO THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE OR COMPLETELY SECURE. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (TORT, CONTRACT OR OTHERWISE) SHALL FRESH START OR ANY OF ITS AFFILIATES, AGENTS, EMPLOYEES, SHAREHOLDERS, DIRECTORS, OFFICERS, THIRD PARTY CONTENT PROVIDERS, SUCCESSORS OR ASSIGNS BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOSS OF DATA, LOSS OF PRODUCTIVITY OR CONTRACT, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. YOUR USE OF THIS SITE IS AT YOUR SOLE RISK AND ANY CONTENT THAT YOU DOWNLOAD IS DOWNLOADED AT YOUR OWN DISCRETION AND RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM IN EXCESS OF THE AMOUNT FRESH START RECEIVED FROM THE SUBSCRIBER FOR A SUBSCRIPTION TO ACCESS THE PREMIUM CONTENT, AND FOR ANY LOSS OF DATA THAT RESULTS FROM THE DOWNLOADING OF ANY SUCH CONTENT, INCLUDING ANY DAMAGES RESULTING FROM COMPUTER VIRUSES. IN NO EVENT WILL FRESH START BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE AMOUNT FRESH START RECEIVED FROM THE SUBSCRIBER FOR A SUBSCRIPTION TO ACCESS THE PREMIUM CONTENT, EVEN IF FRESH START SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. IN NO EVENT WILL WARRANTIES PROVIDED BY LAW, IF ANY, APPLY UNLESS THEY ARE REQUIRED TO APPLY BY STATUTE NOTWITHSTANDING THEIR EXCLUSION BY CONTRACT. THIS DISCLAIMER IS APPLICABLE TO ANY DAMAGE OR INJURY RESULTING FROM THE NEGLIGENCE OR AN OMISSION OF FRESH START, COMPUTER VIRUS OR OTHER SIMILAR ITEM, TELECOMMUNICATIONS ERRORS, OR UNAUTHORIZED ACCESS TO OR USE OF USER INFORMATION THROUGH THEFT OR ANY OTHER MEANS. FRESH START IS NOT LIABLE FOR CRIMINAL, TORTIOUS, OR NEGLIGENT ACTIONS OR OMISSIONS OF THIRD PARTIES THAT AFFECT THIS SITE.

NO DEALER, AGENT, OR EMPLOYEE OF FRESH START IS AUTHORIZED TO MAKE ANY MODIFICATIONS, EXTENSION, OR ADDITIONS TO THESE LIMITED WARRANTIES OR DISCLAIMERS.

FRESH START DISCLAIMS ALL WARRANTIES, AND SHALL HAVE NO LIABILITY FOR DAMAGES IN EXCESS OF THE AMOUNT FRESH START RECEIVED FROM THE SUBSCRIBER, ARISING FROM OR RELATED TO ANY SUPPORT SERVICES FOR YOUR USE OF THE SITE.

THE LAWS OF YOUR JURISDICTION MAY PROHIBIT OR MODIFY THE FOREGOING DISCLAIMERS AND LIMITATIONS ON DAMAGES, AND SUCH DISCLAIMERS OR LIMITATIONS ON DAMAGES MAY NOT APPLY TO YOU.

9. HYPERLINKS TO THIRD-PARTY CONTENT

Fresh Start may contain links and references to other third party Websites and materials. Fresh Start does not assume any responsibility for these Websites or the contents therein and provides these links or materials solely for the convenience of Users. Fresh Start does not endorse or otherwise recommend any of these third party Websites, references, or the products, services, or information there offered. Fresh Start may disable any hyperlink to the Site. Fresh Start has the right but not obligation to monitor third party Websites and hyperlinks to the Site.

You acknowledge that Fresh Start does not pre-screen links to third party materials. Fresh Start is not the publisher or author of any information provided by a third-party Website, and Fresh Start is not liable for any claims related to such information. Content provided by third parties is for informational purposes only, and Fresh Start's use of the content constitutes neither an endorsement nor a recommendation by Fresh Start of the content. Fresh Start assumes no responsibility for third party products or services.

FRESH START MAKES NO WARRANTY, EITHER EXPRESSED OR IMPLIED, OF THE ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THE INFORMATION PROVIDED BY THIRD PARTIES. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY INFORMATION FOUND ON A LINK LOCATED ON THIS SITE THAT ALLOWS USERS TO ACCESS INFORMATION FOUND ON ANOTHER SITE. ADDITIONALLY, FRESH START DOES NOT WARRANT THE EXISTENCE OR FUNCTIONALITY OF ANY WEBSITE WHICH CAN BE ACCESSED THROUGH A LINK LOCATED ON THIS SITE.

10. COPYRIGHTS, TRADEMARKS AND OTHER PROPRIETARY RIGHTS

Fresh Start or its third party content providers shall retain all worldwide rights in the intellectual property in and on the Site, including, but not limited to, trademarks, service marks, trade dress, inventions, ideas, trade secrets, the source code, the HTML code, the "look and feel" of the Site, its color combinations, layout, and all other graphical elements, and the copyrights in and to its original content. You should assume that everything You read or see on the Site is copyrighted, trademarked, or otherwise protected and owned or licensed by Fresh Start. Except as expressly stated on the Site or in these Terms, nothing that You read or see on the Site or in the Premium Content may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use without the prior written consent of Fresh Start, except as provided in these Terms. Nothing in these Terms grants You an express or implied license to use any of Fresh Start's intellectual property except as set forth in Section 3. If You submit any unsolicited intellectual property, idea, copyrightable material, invention, discovery, improvement, trade secret or know-how to Fresh Start, You may forfeit Your intellectual property rights and moral rights contained in such communication or material.

11. INDEMNIFICATION

User agrees to defend, indemnify and otherwise hold harmless Fresh Start and its officers, directors, agents, employees, shareholders, successors and assigns from and against any cause of action or claim, including court costs, expenses and attorney fees, related to or arising from User's Prohibited Conduct or other improper or illegal use of the Site, or breach of these Terms.

12. SECURITY AND AUTHORIZED USE

Users are prohibited from violating or attempting to violate the security of the Site as described in Section 4.2. Fresh Start has the right but not the obligation to investigate occurrences of possible violations and will cooperate with all applicable law enforcement authorities in prosecuting violators. Fresh Start may suspend Your Access while it conducts an investigation. Users are required to enter a user name and password to Access the Premium Content. To protect against unauthorized Access to Your account, it is recommended that You close the browser when You have finished using the Site. You are responsible for maintaining the secrecy of Your user name and password.

You represent and warrant that You are the person on whose behalf You claim to accept these Terms, or, if You are entering into these Terms on behalf of a person or entity, You represent and warrant that You have the power and authority to enter into these Terms and bind the person or entity. You also represent and warrant that You are an adult who is legally able to enter into these Terms.

You may not use the account, user name or password of someone else at any time. You agree to notify Fresh Start immediately of any unauthorized use or loss of Your account, user name, password and/or credit card information. You also agree to notify Fresh Start immediately if You are aware of or suspect other unauthorized use of the Site and/or the Site content. Fresh Start will not be liable for any loss that You incur as a result of someone else using Your user name and password with or without Your knowledge. You may be held liable for any losses incurred by Fresh Start, its affiliates, officers, directors, employees, consultants, agents or representatives due to someone else's use of Your account, user name or password. Fresh Start will never ask You for Your password. If You need a new user name and/or password, Fresh Start will generate a new user name and password automatically through its computers and send it to Your email or postal address.

13. TERMINATION OF AGREEMENT

In addition to Fresh Start's other rights, it may terminate this Agreement at any time and at its sole and absolute discretion. Fresh Start may also terminate Access to the Premium Content or cancel subscriptions to the Premium Content without notice if it believes, in its sole judgment, that You have breached or may breach any term or condition of this Agreement, or engaged in conduct that Fresh Start deems inappropriate.

In the event of termination of this Agreement, the provisions in this Section and the provisions found in Sections 1, 4, 5, 8, 9, 10, 11, 12, 13, 14, and 15 shall survive in perpetuity. Each Subscriber's obligation to pay outstanding subscription fees shall survive any termination of this Agreement.

14. MISCELLANEOUS

These Terms constitute the entire agreement between Fresh Start and User regarding the subject matter hereof. Any previous agreement, whether oral or written, between Fresh Start and User dealing with the subject matter hereof is superseded. These Terms may only be modified or amended in writing. If any portion of these Terms is determined to be unenforceable for any reason, such portion will be deemed severed and the remaining terms and conditions shall continue in full force and effect. Upon User's breach or threatened breach of these Terms, Fresh Start may pursue any legal or equitable remedy available, including but not limited to, direct, consequential and punitive damages and injunctive relief. Fresh Start's remedies are cumulative and not exclusive. Failure of Fresh Start to exercise any remedy or enforce any portion of this Agreement at any time shall not operate as a waiver of any remedy or of the right to enforce any portion of the Agreement at any time thereafter. User agrees that regardless of any statute or law to the contrary, any claim or action arising out of or regarding this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. By Accessing the Site, User signs for and accepts this shortening of the statutes of limitations. Fresh Start makes no representation that the content of the Site is appropriate or available for use in all locations. Fresh Start operates this Site from the United States and makes no representation that the Site complies with any foreign or international laws. You agree to comply with all applicable local laws, including any international laws, in using this Site. You may not assign Your rights or delegate Your duties under these Terms. The parties agree that no third party is an intended beneficiary of these Terms. Fresh Start cannot provide notifications via post, only e-mail.

15. GOVERNING LAW, DISPUTE RESOLUTION, FORUM AND VENUE.

These Terms and any claim or action related to or arising from these Terms or content on the Site shall be governed by Arizona law, without regard to any provision that would make the laws of another jurisdiction applicable. All disputes between You and Fresh Start shall be finally resolved through binding arbitration in Phoenix, Arizona. The arbitration shall be conducted by one (1) arbitrator. The parties shall conduct discovery as agreed upon or as permitted by the arbitrator. A party may file for an order on the arbitration decision exclusively in the Arizona Superior Court, County of Maricopa or the United States District Court for the District of Arizona. The parties shall share equally the costs of the arbitrator, arbitration body and arbitration facilities (if applicable). Each party may bring a claim or action for injunctive relief without submitting the claim to final and binding arbitration. Each party consents to the exclusive jurisdiction and venue of the Arizona Superior Court, County of Maricopa or the United States District Court for the District of Arizona for any equitable claim or other action related to or arising from these Terms. Each party shall bear his/her/its own expenses and attorneys' fees related to any arbitration, claim or action.
